Terms and Conditions and Personal Data Processing – Marketing Consultations and Education

These terms also contain information about the processing of personal data pursuant to Articles 13 and 14 of the GDPR (see section 8).

1. Provider
Services are provided by Miloslav Formánek, ID: 06353088, VAT ID: CZ8606054985, based in Czechia, Europe. Contact: milan@formanek.bio, +420 602 292 054. Bank details: Air Bank, a.s., account number: 1431799031/3030, IBAN: CZ5530300000001431799031, BIC: AIRACZPP. Hereinafter referred to as the "Consultant."

2. Subject of the Agreement
The Consultant provides consultations and educational services in the fields of marketing, communication, strategy, and professional development, either in person, online, or through digital tools, workshops, and training.

3. Service Booking
A service is agreed upon by mutual arrangement of a time slot. The Consultant is not obliged to respond to unsolicited inquiries without prior arrangement.

4. Fees
The price is listed on the Consultant’s website or communicated in advance via email. Payment is made based on an invoice issued by the Consultant. The minimum charge applies to each commenced 15-minute interval. The Consultant usually issues invoices after completing a deliverable, a part of the service, or a block of consultations. For VAT purposes, the date of taxable supply is considered to be the date of invoice issuance unless otherwise agreed. The client expressly agrees to this arrangement.

5. Cancellation Policy
Cancellations must be made at least 24 hours in advance. In the event of a later cancellation, the Consultant may charge for 1 hour.

6. Process and Liability
Consultations take place at the agreed time. Any delay on the client's part is included in the billed time. The Consultant is not liable for decisions made by the client based on the consultation.

7. Confidentiality
Both parties agree to maintain confidentiality regarding information shared during consultations.

8. Personal Data Protection
The Consultant is the data controller under Regulation (EU) 2016/679 (GDPR). The Consultant processes clients' personal data (e.g., name, email, billing information) for the purpose of providing services, maintaining records, fulfilling legal obligations (e.g., tax), and sending professional content and newsletters related to marketing and education, which are contextually relevant to the services purchased. The client may unsubscribe from the newsletter at any time via the unsubscribe link in each email or by request sent to the Consultant.

The legal basis for processing is:

  • the performance of a contract (Art. 6(1)(b) GDPR),

  • the Consultant's legitimate interest (communication with clients, informing about related services and content),

  • compliance with legal obligations (accounting, tax laws).

Data is retained for as long as necessary to fulfill the purposes of processing, particularly for the duration of the collaboration and thereafter as required by legal regulations or to protect the Consultant's legitimate interests. Personal data is not shared with third parties, except for accounting, email, and cloud service providers (e.g., Google Workspace), and only to the necessary extent and always under contractual data protection safeguards. The client has the right to access their data, correct or erase it, restrict processing, request data portability, object to processing, and lodge a complaint with the Czech Data Protection Authority (ÚOOÚ). The Consultant has implemented technical and organizational measures to protect personal data against misuse. Inquiries or data protection requests can be sent to milan@formanek.bio.

9. Final Provisions
By ordering the service, the client confirms agreement with these terms. The Consultant reserves the right to amend the terms and conditions.
